- Legal Questions
- What is an offer to purchase?
The offer to purchase, also called a promise to buy, is presented in writing. It is a contract where a person commits themselves to buy a property. This document also shows that the seller formally commits themselves to sell their property if the conditions are agree upon by the two parties. When a buyer submits an offer to purchase, three possibilities arise:
- Accept the offer;
- Reject the offer as is;
- Reply with a counter offer.
Carefully read the form before using it. If you accept the offer to purchase, it becomes an irrevocable contract. You must repsect the conditions of sale in the contract, otherwise you can be legally pursued. It's for this reason that you should have the offer to purchase verified.

- What is the role of the lawyer or notary in the sale process?
Wether you sell with or without an agent, it's the lawyer/notary who closes the agreement between the buyer and seller. The buyer and seller then provide a copy of the signed offer to purchase to the lawyer/notary. They will then complete the following tasks:
- Analyse the titles: The lawyer/notary guarantees the buyer a valid and transferable property title.
- Editing the bill of sale: The lawyer/notary approved bill of sale, in accordance with the laws, will transfer the property from the buyer to the seller.
- Adjustment state: The adjustment state confirms the selling price, the amount the buyer already gave the seller, as well as the initial payment amount and the adjustments. The buyer must provide an authorized cheque or money order.
- Register the sale.
Except for a new home, the choice and charge of a lawyer or notary is up to the buyer.
- How can I find a lawyer or notary in my region?
Visit our virtual shopping center. You will see a map with all the Quebec districts. Clic on the one you want and choose in the drop down list the type of service you need (in this case "notary/lawyer") then activate your search to find the information you need.
- What is a zoning certificate?
A zoning certificate is a document certified by a surveyor; they describe the property with a plan of the lot (land, prinicpal and secondary buildings). They are current with the status of the property, laws and municipal regulations.
Financial institutions always request an up to date zoning certificate. This responsibility falls to the seller. However, it is a good idea for the buyer to specify this in the offer to purchase.
